Yesterday, the Constitutional Court decided, with a majority of votes,
that the article number 25 in the Regulations of the Deputiesâ Chamber is unconstitutional.

FUNCTION. Nastase has been proposed by the SDP, not by the NLP - DP

This article reads that "any member of the Permanent Bureau could have his mandate revoked before its expiry date, due to the reasoned request of the parliamentary that proposed him or of at least a third of the deputies belonging to three different parliamentary groups". On January 12, the president of the Deputiesâ Chamber, Adrian Nastase, contested this article. The Court concluded that the article is unconstitutional, because it permits that the proposal of revoking the president of the Deputiesâ Chamber to be made by other parliamentary groups than the ones that proposed him. As a conclusion, according to this decision, the parliamentary groups of the NLP (National Liberal Party) and of the DP (Democratic Party) cannot ask for the revocation of Adrian Nastase as president of the Chamber, because the SDP (Social Democratic Party) proposed him, not them. The Decision of the Constitutional Court is final and is to be published in the Official Gazette. Following the Courtâs decision, Adrian Nastase said that the "cohabitation formula that resulted after the elections can go on".
The liberal deputiesâ leader, Eugen Nicolaescu, stated in his turn that the Alliance doesnât see "a goal" in replacing Adrian Nastase from his function as the president of the Deputiesâ Chamber. "We will propose the modification of the regulations in order to make the Chamberâs activity more transparent", Nicolaescu said.
SENATE. On the other hand, yesterday, the leader of the NLP - DP group of senators, Puiu Hassoti, said that a procedure similar to the one applied at the Deputiesâ Chamber should be taken into account for replacing the Senateâs president. Hassoti said that if this procedure is declared unconstitutional, they would have to obey the decision. (
